Terms of Service

The terms that govern your use of gitfile.dev and its API.

Last updated October 3, 2026

1. Acceptance

By accessing or using gitfile.dev or its API (the "Service"), you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service. Before you sign in you confirm these documents with a checkbox, and we record which version you accepted and when; if they change materially we'll ask you to accept the new version. Until you do, your account is read-only, in the dashboard and in the API: changes are rejected, but you can still read your data and delete your account.

2. Provider details

The Service is provided by Starhub SPA, RUT 77.500.684-6, domiciled at Av. Manuel Antonio Matta 277, Santiago, Chile. Phone: +56 2 2459 2493. Complaints channel: contacto@starhub.cl. You can also reach us at contact@gitfile.dev.

3. What Gitfile is

Gitfile generates a dynamic banner-style image and a public profile page from your GitHub or GitLab account data, configurable through a live editor and a REST API. Gitfile is not affiliated with, endorsed by, or sponsored by GitHub, Inc. or GitLab Inc.

4. Accounts

  • You need a GitHub or GitLab account to sign in. You're responsible for keeping your provider credentials, any personal access token you paste, and any Gitfile API keys secret.
  • You must be at least 16 years old, or the age of digital consent in your country if higher, to use the Service.
  • Information you configure (display name, bio, and similar fields) must be accurate and must not impersonate someone else.

5. Acceptable use

You agree not to:

  • Use the Service to store or display unlawful, hateful, or infringing content in your banner or profile fields.
  • Attempt to circumvent rate limits, scrape the Service at scale (including bulk collection of profiles of people who don't use Gitfile), or use endpoints beyond what the published API supports.
  • Use another person's account, token or API key without authorization.
  • Interfere with or disrupt the Service's infrastructure.

We may suspend or terminate access for accounts that violate this section.

6. Your content

You retain ownership of your provider data and anything you configure in your dashboard. By using the Service, you grant Gitfile a non-exclusive, worldwide, royalty-free license to host, process and display that data on your public banner and profile page URL, exactly as configured, and only while your "Public profile" toggle is on and your account exists. You are responsible for what you configure and warrant that you have the right to publish it.

7. Reports and takedown

If you believe content on Gitfile is unlawful, infringes your rights, or impersonates you, send a report to contact@gitfile.dev with: the URL, what the problem is and why, your name and contact details, and a statement that the information is accurate. We aim to review reports within 7 days and may remove or disable the content, and notify the account owner. The owner may reply with a counter-notice explaining why the content should be restored; we then decide, and may restore it if the report is not substantiated. Repeated or abusive reports, or repeated infringement, may lead to suspension.

8. Intellectual property

The Gitfile name, logo, software, templates and design belong to Starhub SPA or its licensors. Nothing in these Terms transfers them to you; you may use the Service and the banners it generates for your own profiles and projects.

9. Third-party trademarks

"GitHub" and "GitLab" and their logos are trademarks of their respective owners and are used here only to identify the services Gitfile integrates with. Their use does not imply affiliation or endorsement.

10. API keys

API keys are a separate credential from your provider OAuth grant — they only ever authorize access to your own Gitfile configuration, never your GitHub or GitLab account directly. Keep them secret; you're responsible for activity performed with a key you generated until you revoke it.

11. Availability

We aim to keep the Service available and your banner cache current, but we don't guarantee uninterrupted uptime, and rendered stats may lag your live provider activity by up to the caching window described in our docs.

12. Disclaimers

Subject to any rights you cannot waive under applicable law, the Service is provided "as is" and "as available," without warranties of any kind, express or implied. We don't warrant that banner data will always be accurate, complete, or uninterrupted.

13. Limitation of liability

To the maximum extent permitted by law, Starhub SPA won't be liable for indirect, incidental, special, or consequential damages arising from your use of the Service, or for inaccuracies in the provider data it displays. Nothing in these Terms excludes or limits liability for fraud, willful misconduct (dolo) or gross negligence (culpa grave), or any right that cannot be waived under law, including your rights as a consumer under Ley 19.496.

14. Indemnity

You agree to hold Starhub SPA harmless from third-party claims arising from content you configure or from your breach of these Terms, to the extent permitted by law.

15. Termination

You may stop using the Service at any time: disconnect a provider (which revokes our access and deletes stored tokens but keeps your account) or delete your account from Dashboard → Privacy, which is immediate and permanent (see the Privacy Policy for what it does and doesn't remove). We may suspend or terminate your access for violating these Terms, with notice where practical.

16. Third-party services

The Service depends on GitHub's and GitLab's APIs and on infrastructure providers (AWS, Vercel). We aren't responsible for their availability, and your use of those services is governed by their own terms.

17. Changes

We may update these Terms as the Service evolves. We'll update the "Last updated" date and, for material changes, surface a notice in the dashboard and ask you to accept the new version.

18. Severability

If any provision of these Terms is found unenforceable, the rest remains in effect.

19. Governing law

These Terms are governed by the laws of the Republic of Chile, without regard to conflict-of-law principles. Any dispute will be submitted to the competent courts of Santiago, Chile — this doesn't limit any mandatory consumer-protection rights you may have under the law of your own country of residence.
